Lindsay Clancy Returns To Court After Mistrial

Lindsay Clancy is set to return to court Tuesday for the first time since her murder trial ended with a deadlocked jury, as her attorneys seek to prevent prosecutors from putting her on trial a second time.
Clancy is charged in the 2023 deaths of her three young children — 5-year-old Cora, 3-year-old Dawson and 8-month-old Callan — at the family’s home in Duxbury, Massachusetts. She has not disputed killing the children, but her defense maintains she was suffering from postpartum psychosis and was not criminally responsible for her actions.
Her first trial ended Sept. 4 when Judge William Sullivan declared a mistrial after seven days of deliberations. The jury was reportedly split 11-to-1, with 11 jurors prepared to find Clancy not guilty by reason of lack of criminal responsibility.
Clancy’s attorneys have since filed several motions aimed at preventing a retrial. They are asking Sullivan to dismiss the criminal case on double-jeopardy grounds and have also renewed a request for the judge to enter a finding of not guilty by reason of lack of criminal responsibility.
The defense has also raised questions about the lone holdout juror. Attorneys have asked the court to investigate whether the juror was truthful during jury selection and later questioning, as well as allegations that the juror may have violated court rules by using a cellphone during deliberations.
Prosecutors argued during the trial that Clancy was mentally ill but still understood what she was doing when she killed the children. Her defense argued that postpartum psychosis left her unable to appreciate the wrongfulness of her actions.
The Plymouth County District Attorney’s Office has not publicly announced whether it will seek another trial. Prosecutors could retry Clancy on first-degree murder charges, pursue lesser charges such as second-degree murder or manslaughter, or decide not to retry the case.
Tuesday’s hearing could provide the clearest indication yet of what comes next in the closely watched case. Clancy remains charged with murder and is being held at a state psychiatric hospital while the case remains unresolved.
