Lawyers Seek Permanent Dismissal In Lincoln Memorial Reflecting Pool Case

Lawyers for former Olympian David Hearn are asking a federal judge to permanently dismiss the criminal case accusing him of damaging the Lincoln Memorial Reflecting Pool, arguing the Justice Department knew for weeks that its case was fundamentally flawed.
The request comes after U.S. Attorney Jeanine Pirro moved last week to dismiss the indictment, citing newly produced evidence from the Interior Department that concluded Hearn was not responsible for the damage. Prosecutors now say the damage was caused by a faulty installation by a contractor during a rushed construction schedule.
Hearn's attorneys want the case dismissed with prejudice, which would prevent the Justice Department from bringing the same charges against him again in the future.
